V sou\u010dasn\u00e9 dob\u011b je katastr nemovitost\u00ed ji\u017e t\u0159i dny mimo provoz a katastr\u00e1ln\u00ed odbory pracuj\u00ed pouze v omezen\u00e9m re\u017eimu. Objevily se zpr\u00e1vy, \u017ee se katastr stal ter\u010dem <strong>kybernetick\u00e9ho \u00fatoku<\/strong>, a dokonce se spekuluje, \u017ee katastr p\u0159i\u0161el o v\u0161echna data. \u00da\u0159ady jsou na informace skoup\u00e9, ale v\u00edme, \u017ee se p\u0159\u00edpadem ji\u017e zab\u00fdv\u00e1 <strong>policie<\/strong>.   <\/p>\n\n<p>N\u00ed\u017ee popisuji sou\u010dasn\u00fd stav katastru nemovitost\u00ed a n\u011bkter\u00e9 probl\u00e9my, kter\u00e9 mohly zp\u016fsobit sou\u010dasn\u00fd v\u00fdpadek katastru nemovitost\u00ed.<\/p>\n\n<h2 class=\"wp-block-heading\">Z\u00e1pisy &#8211; nedodr\u017een\u00ed term\u00edn\u016f, p\u0159\u00edli\u0161n\u00e1 form\u00e1lnost<\/h2>\n\n<p>Ro\u010dn\u011b p\u0159ich\u00e1zej\u00ed do katastru <strong>statis\u00edce<\/strong> smluv, kter\u00e9 mus\u00ed b\u00fdt zaevidov\u00e1ny v z\u00e1konn\u00e9 lh\u016ft\u011b. V sou\u010dasn\u00e9 dob\u011b se za ka\u017edou \u017e\u00e1dost (n\u00e1vrh) plat\u00ed standardn\u00ed poplatek ve v\u00fd\u0161i 100 EUR. N\u011bkter\u00e9 okresn\u00ed \u00fa\u0159ady lh\u016ftu pro proveden\u00ed vklad\u016f respektuj\u00ed, jin\u00e9 nikoli. Z vlastn\u00ed zku\u0161enosti v\u00edm, \u017ee obsazov\u00e1n\u00ed \u00fa\u0159ad\u016f chyb\u011bj\u00edc\u00edmi &#8222;vkladateli&#8220; je \u010dasto pomal\u00e9 a nepru\u017en\u00e9. Zam\u011bstnanci chyb\u00ed, pracuj\u00ed ve stresu za n\u00edzkou mzdu, poplatky se vracej\u00ed a lid\u00e9 hledaj\u00ed r\u016fzn\u00e9 vedlej\u0161\u00ed cesty, jak si vy\u0159\u00eddit z\u00e1kladn\u00ed v\u011bci.    <\/p>\n\n<p>Postup p\u0159i registraci smluv podle katastr\u00e1ln\u00edho z\u00e1kona tak\u00e9 nen\u00ed ide\u00e1ln\u00ed a zlep\u0161uje se jen pomalu. Jeho <strong>extr\u00e9mn\u00ed<\/strong> <strong>form\u00e1lnost<\/strong> \u010dasto zbyte\u010dn\u011b zdr\u017euje nabyt\u00ed vlastnictv\u00ed.   <\/p>\n\n<p>Slo\u017eit\u00e1 legislativa, nekvalitn\u00ed v\u00fdb\u011brov\u00e1 \u0159\u00edzen\u00ed, n\u00edzk\u00e9 platy a v d\u016fsledku toho ni\u017e\u0161\u00ed odborn\u00e1 \u00farove\u0148 vkladatel\u016f a zapisovatel\u016f jsou jevy, kter\u00e9 vytv\u00e1\u0159ej\u00ed ide\u00e1ln\u00ed prost\u0159ed\u00ed pro <strong>korup\u010dn\u00ed <\/strong>jedn\u00e1n\u00ed.<\/p>\n\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1-1024x576.jpg\" alt=\"v&#xFD;padek katastr&#xE1;ln&#xED;ho stavu\" class=\"wp-image-10284\" style=\"width:644px;height:auto\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1-1024x576.jpg 1024w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1-300x169.jpg 300w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1-768x432.jpg 768w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1-600x338.jpg 600w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2024\/12\/navod-katastralna-mapa-vyhladava-1.jpg 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>-<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\">Nezvl\u00e1dnut\u00e1 elektronizace &#8211; d\u016fvod v\u00fdpadku katastru?<\/h2>\n\n<p>Zam\u011bstnanci katastru nemovitost\u00ed jsou zvykl\u00ed jednou za 5 let absolvovat \u0161kolen\u00ed na nov\u00fd program, kter\u00fd m\u00e1 katastr posunout &#8222;dop\u0159edu&#8220;, ale po \u0161kolen\u00ed se po nich jakoby slehne zem a oni d\u00e1l pou\u017e\u00edvaj\u00ed aplikace v pr\u00e1ci  <strong>z 90. let <\/strong>  20. stolet\u00ed. Alespo\u0148 tak tomu bylo do roku 2017, kdy jsem katastr opustil.  <\/p>\n\n<p>Z katastr\u00e1ln\u00edho z\u00e1kona je patrn\u00e1 snaha o postupnou elektronizaci cel\u00e9ho katastr\u00e1ln\u00edho \u0159\u00edzen\u00ed, ale v praxi se tak d\u011bje zp\u016fsobem, kter\u00fd pr\u00e1ci \u00fa\u0159edn\u00edk\u016f je\u0161t\u011b v\u00edce komplikuje. Existuje z\u0159ejm\u00fd rozpor mezi obrazem katastru z pohledu ob\u010dana a z pohledu \u00fa\u0159edn\u00edka. Ob\u010dan vid\u00ed p\u0159edev\u0161\u00edm pozitiva &#8211; nov\u00e9 webov\u00e9 str\u00e1nky a mo\u017enost poslat \u017e\u00e1dost na katastr z domova. \u00da\u0159edn\u00edci naopak vid\u00ed <strong>zastaral\u00e9<\/strong> <strong>programy, kter\u00e9 <\/strong> <strong>jim pr\u00e1ci<\/strong> <strong>neusnad\u0148uj\u00ed<\/strong>.     <\/p>\n\n<p>Po\u0159izov\u00e1n\u00ed aplikac\u00ed katastr\u00e1ln\u00edm odborem n\u011bkdy vyvol\u00e1valo dojem, \u017ee \u00fa\u010delem nov\u00fdch program\u016f nen\u00ed usnadnit pr\u00e1ci, ale utratit pen\u00edze. To potvrzuje i skute\u010dnost, \u017ee \u00da\u0159ad geod\u00e9zie, kartografie a katastru SR musel v minulosti vracet pen\u00edze za<strong> nez\u00e1konn\u00e9 zad\u00e1v\u00e1n\u00ed ve\u0159ejn\u00fdch zak\u00e1zek<\/strong> (viz <a href=\"https:\/\/index.sme.sk\/c\/20516282\/kataster-bude-splacat-miliony-za-pochybny-tender-o-vinnikoch-mlcia.html\" target=\"_blank\" rel=\"noopener\">\u010dl\u00e1nek<\/a>). Dobr\u00fdm p\u0159\u00edkladem \u0161patn\u00e9ho hospoda\u0159en\u00ed a pl\u00fdtv\u00e1n\u00ed je tzv. ob\u00e1lkovac\u00ed stroj &#8211; za\u0159\u00edzen\u00ed na zas\u00edl\u00e1n\u00ed rozhodnut\u00ed, kter\u00e9 st\u00e1lo hodn\u011b pen\u011bz, ale fungovalo jen kr\u00e1tce. Zat\u00edm nen\u00ed jasn\u00e9, zda bylo v\u011bt\u0161\u00edm \u00fasp\u011bchem spu\u0161t\u011bn\u00ed ob\u00e1lkovac\u00edho stroje, nebo jeho zru\u0161en\u00ed.    <\/p>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\">Neexistuj\u00ed \u017e\u00e1dn\u00e9 z\u00e1lohy?<\/h2>\n\n<p>Nebylo by proto p\u0159ekvapen\u00edm, kdyby \u0161patn\u011b \u0159\u00edzen\u00e9 odd\u011blen\u00ed se zastaral\u00fdm vybaven\u00edm nedok\u00e1zalo odolat kybernetick\u00e9mu \u00fatoku a p\u0159i\u0161lo o v\u0161echna sv\u00e1 data. To by znamenalo, \u017ee odd\u011blen\u00ed <strong>nem\u00e1 dostate\u010dn\u011b z\u00e1lohovan\u00e1 data<\/strong>. Jednalo by se o z\u00e1va\u017en\u00e9 mana\u017eersk\u00e9 selh\u00e1n\u00ed ze strany CCDC, ale tak\u00e9 o selh\u00e1n\u00ed z\u00e1kladn\u00ed funkce st\u00e1tu &#8211; ochrany majetku ob\u010dan\u016f. Bez katastr\u00e1ln\u00edch \u00fadaj\u016f by ob\u010dan\u00e9 obt\u00ed\u017en\u011b prokazovali sv\u00e9 vlastnictv\u00ed a vznikl by <strong>prostor pro obohacov\u00e1n\u00ed<\/strong> pozemk\u016f &#8222;neaktivn\u00edch&#8220; vlastn\u00edk\u016f, podobn\u011b jako v 90. letech minul\u00e9ho stolet\u00ed, kdy byly katastr\u00e1ln\u00ed \u00fadaje ne\u00fapln\u00e9 a doch\u00e1zelo k mnoha podvodn\u00fdm obohacen\u00edm (viz <a href=\"https:\/\/www.ondrejhalama.sk\/podvodne-vydrzania-osvedcenie-o-opravnenej-drzbe\/\">\u010dl\u00e1nek na<\/a> toto t\u00e9ma).    <\/p>\n\n<p>Z\u00e1rove\u0148 by se t\u00edm zni\u010dilo n\u011bkolik desetilet\u00ed pr\u00e1ce na tvorb\u011b katastr\u00e1ln\u00edch dat a samoz\u0159ejm\u011b i <strong>obrovsk\u00e9 n\u00e1klady na<\/strong> jejich obnovu.  <\/p>\n\n<h2 class=\"wp-block-heading\">Zru\u0161en\u00ed pap\u00edrov\u00fdch osv\u011bd\u010den\u00ed o vlastnictv\u00ed<\/h2>\n\n<p>P\u0159esto\u017ee podle vyhl\u00e1\u0161ky maj\u00ed b\u00fdt listy vlastnictv\u00ed vedeny v <strong>elektronick\u00e9<\/strong> i <strong>listinn\u00e9 podob\u011b<\/strong>, vydal \u00da\u0159ad st\u00e1tn\u00edho zmocn\u011bnce pro majetek p\u0159ed deseti lety pokyn, kter\u00fd \u00fa\u0159ad\u016fm na\u0159izuje pozastavit aktualizaci list\u016f vlastnictv\u00ed v listinn\u00e9 podob\u011b. Tento pokyn je v p\u0159\u00edm\u00e9m rozporu s \u00a7 7 vyhl\u00e1\u0161ky \u010d. 461\/2009 Sb. Lze tak\u00e9 konstatovat, \u017ee veden\u00ed \u00da\u0159adu pro zastupov\u00e1n\u00ed st\u00e1tu ve v\u011bcech majetkov\u00fdch nepostupuje v\u017edy profesion\u00e1ln\u011b a v souladu se z\u00e1konem. \u00da\u0159ady, kter\u00e9 se \u0159\u00eddily t\u00edmto pokynem, a nikoliv vyhl\u00e1\u0161kou, budou m\u00edt o to v\u011bt\u0161\u00ed probl\u00e9my v p\u0159\u00edpad\u011b, \u017ee se \u00fadaje v katastru skute\u010dn\u011b ztratily.  <\/p>\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2025\/01\/usm_ugkk-sr_40_2013.pdf\" type=\"application\/pdf\" style=\"width:100%;height:200px\" aria-label=\"Vlo\u017eit z usm_ugkk-sr_40_2013.\"><\/object><a id=\"wp-block-file--media-cd382925-60f3-4799-a315-c6de98f0791c\" href=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2025\/01\/usm_ugkk-sr_40_2013.pdf\">usm_ugkk-sr_40_2013<\/a><a href=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2025\/01\/usm_ugkk-sr_40_2013.pdf\" class=\"wp-block-file__button wp-element-button\" download=\"\" aria-describedby=\"wp-block-file--media-cd382925-60f3-4799-a315-c6de98f0791c\">St\u00e1hnout<\/a><\/div>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\">&#8222;Mrtv\u00e1 m\u00edsta&#8220; byla vytvo\u0159ena ji\u017e v minulosti.<\/h2>\n\n<p>Obdob\u00ed socialismu m\u011blo z\u00e1sadn\u00ed vliv na evidenci nemovitost\u00ed, kdy bylo \u010d\u00e1ste\u010dn\u011b p\u0159eru\u0161eno vlastnictv\u00ed (zejm\u00e9na v 50.-60. letech 20. stolet\u00ed). D\u00e1le se nemovitosti prod\u00e1valy, projedn\u00e1vala se d\u011bdictv\u00ed, ale mnoh\u00e9 z t\u011bchto pr\u00e1vn\u00edch zm\u011bn se <strong>ji\u017e neevidovaly<\/strong>. T\u00edm za\u010dala vznikat <strong>mrtv\u00e1 m\u00edsta v<\/strong> evidenci. Je obt\u00ed\u017en\u00fdm \u00fakolem prozkoumat chronologii vlastnick\u00fdch vztah\u016f a doplnit rejst\u0159\u00edk tak, aby v n\u011bm byly zaps\u00e1ny v\u0161echny nemovitosti a zm\u011bny. O jeho obt\u00ed\u017enosti sv\u011bd\u010d\u00ed i to, \u017ee se jej dosud nepoda\u0159ilo zcela dos\u00e1hnout. Nov\u00ed vlastn\u00edci a mapy se do katastru dopl\u0148uj\u00ed prost\u0159ednictv\u00edm tzv. registru obnoven\u00e9 evidence pozemk\u016f (ROEP), \u010dasto povrchn\u011b a s chybami. K p\u0159ehlednosti katastr\u00e1ln\u00ed evidence nep\u0159isp\u00edv\u00e1 ani skute\u010dnost, \u017ee ka\u017ed\u00e9 katastr\u00e1ln\u00ed \u00fazem\u00ed je evidov\u00e1no na <strong>dvou r\u016fzn\u00fdch map\u00e1ch <\/strong>(katastr\u00e1ln\u00ed mapa a mapa ur\u010den\u00e9ho oper\u00e1tu).       <\/p>\n\n<h2 class=\"wp-block-heading\">Dal\u0161\u00ed probl\u00e9my katastru nemovitost\u00ed<\/h2>\n\n<p>Probl\u00e9m\u016f v katastru je v\u00edce a zm\u00edn\u00edm se o n\u011bkter\u00fdch dal\u0161\u00edch, kter\u00e9 m\u011b napadly:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>neza\u010dlen\u011bn\u00ed n\u011bkter\u00fdch (zejm\u00e9na in\u017een\u00fdrsk\u00fdch) staveb a nemo\u017enost jejich prodeje,<\/li>\n\n\n\n<li>matouc\u00ed definice a formulace v katastr\u00e1ln\u00edm z\u00e1kon\u011b (nap\u0159. definice pozemku nebo \u00a7 79i),<\/li>\n\n\n\n<li>z list\u016f vlastnictv\u00ed \u010dasto nelze ur\u010dit rozsah m\u011bstsk\u00fdch pozemk\u016f ve spr\u00e1v\u011b pozemkov\u00e9ho spole\u010denstv\u00ed,<\/li>\n\n\n\n<li>matouc\u00ed z\u00e1pisy na listu vlastnictv\u00ed, nap\u0159. nab\u00fdvac\u00ed titul ve tvaru &#8222;Kupn\u00ed smlouva \u010d. V 223\/2010 ze dne 2. 2. 2009&#8220;, kde datum neodpov\u00edd\u00e1 datu uzav\u0159en\u00ed smlouvy, ale datu povolen\u00ed vkladu, a \u010d\u00edslo &#8222;V 223\/2010&#8220; nen\u00ed \u010d\u00edslem smlouvy, ale \u010d\u00edslem vkladu (resp. \u010d\u00edslem rozhodnut\u00ed o povolen\u00ed vkladu).  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">N\u011bkolik doporu\u010den\u00ed na z\u00e1v\u011br<\/h2>\n\n<p>V minulosti se uk\u00e1zalo, \u017ee zm\u011bny z\u00e1kon\u016f a pokyn\u016f pro registraci majetku by m\u011bly b\u00fdt prov\u00e1d\u011bny velmi opatrn\u011b, tak\u017ee zm\u011bny by m\u011bly b\u00fdt prov\u00e1d\u011bny pouze postupn\u011b a po pe\u010dliv\u00e9m zv\u00e1\u017een\u00ed. Nam\u00edsto zcela nov\u00fdch z\u00e1kon\u016f (ned\u00e1vno byl p\u0159ipraven nov\u00fd katastr\u00e1ln\u00ed z\u00e1kon) by bylo mnohem prosp\u011b\u0161n\u011bj\u0161\u00ed zkr\u00e1tit dobu a prov\u00e9st n\u011bkolik drobn\u00fdch \u00faprav.   <\/p>\n\n<p>Sou\u010dasn\u00fd model m\u00edstn\u00ed spr\u00e1vy, kter\u00fd byl zaveden v roce 2013 a kter\u00fd prohloubil pot\u0159ebu \u0159e\u0161it person\u00e1ln\u00ed i materi\u00e1ln\u00ed pot\u0159eby \u00fa\u0159ad\u016f, je rovn\u011b\u017e t\u0159eba zm\u011bnit.  <\/p>\n\n<p>Je tak\u00e9 nutn\u00e9 zv\u00e1\u017eit, zda nahradit pap\u00edrovou katastr\u00e1ln\u00ed dokumentaci elektronickou, nebo v\u00e9st ob\u011b sou\u010dasn\u011b. Je tak\u00e9 nutn\u00e9 pokra\u010dovat v katastr\u00e1ln\u00edm \u0159\u00edzen\u00ed v tradi\u010dn\u00ed pap\u00edrov\u00e9 podob\u011b, jinak budou \u00fa\u0159ady nedostupn\u00e9 pro po\u010d\u00edta\u010dov\u011b negramotn\u00e9 a m\u00e9n\u011b majetn\u00e9 ob\u010dany. C\u00edlem by v\u0161ak m\u011bl b\u00fdt prav\u00fd opak &#8211; zlep\u0161it p\u0159\u00edstup k \u00fa\u0159ad\u016fm.
