{"id":11098,"date":"2024-12-22T19:20:28","date_gmt":"2024-12-22T18:20:28","guid":{"rendered":"https:\/\/www.ondrejhalama.sk\/stavebni-pozemky-definice-2024\/"},"modified":"2025-02-10T20:19:56","modified_gmt":"2025-02-10T19:19:56","slug":"stavebni-pozemky-definice-2024","status":"publish","type":"post","link":"https:\/\/www.ondrejhalama.sk\/cs\/stavebni-pozemky-definice-2024\/","title":{"rendered":"Stavebn\u00ed pozemky &#8211; definice (2024)"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Stavebn\u00ed pozemek &#8211; ze z\u00e1kona<\/strong><\/h2>\n\n<p><br\/>Definice podle \u00a7 43h stavebn\u00edho z\u00e1kona zn\u00ed:<em>&#8222;Stavebn\u00edm pozemkem se rozum\u00ed \u010d\u00e1st \u00fazem\u00ed ur\u010den\u00e1 \u00fazemn\u00edm pl\u00e1nem obce nebo \u00fazemn\u00edm pl\u00e1nem z\u00f3ny nebo \u00fazemn\u00edm rozhodnut\u00edm k zastav\u011bn\u00ed a pozemek zastav\u011bn\u00fd stavbou.&#8220;.<\/em><\/p>\n\n<p>Tato definice ve stavebn\u00edm <a href=\"https:\/\/www.zakonypreludi.sk\/zz\/1976-50\" target=\"_blank\" rel=\"noopener\">z\u00e1kon\u011b<\/a> je pom\u011brn\u011b \u0161irok\u00e1, proto\u017ee na mnoha pozemc\u00edch lze postavit n\u011bjakou stavbu (nap\u0159. obytnou nebo zem\u011bd\u011blskou apod.).<\/p>\n\n<h2 class=\"wp-block-heading\"><br\/><strong>Stavebn\u00ed pozemek &#8211; v b\u011b\u017en\u00e9 \u0159e\u010di<\/strong><\/h2>\n\n<p>V b\u011b\u017en\u00e9 \u0159e\u010di se stavebn\u00edm pozemkem rozum\u00ed p\u0159edev\u0161\u00edm pozemek, na kter\u00e9m <strong>lze<\/strong> stav\u011bt rodinn\u00e9 domy, bytov\u00e9 domy nebo komer\u010dn\u00ed budovy. Tento term\u00edn se pou\u017e\u00edv\u00e1 p\u0159edev\u0161\u00edm v reklam\u011b. <\/p>\n\n<p>Pokud tedy chcete ov\u011b\u0159it, zda je pozemek skute\u010dn\u011b stavebn\u00edm pozemkem, mus\u00edte se ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f pod\u00edvat do \u00fazemn\u00edch <strong>pl\u00e1n\u016f <\/strong>nebo \u00fazemn\u00edch rozhodnut\u00ed (pokud existuj\u00ed). Katastr\u00e1ln\u00ed z\u00e1kon m\u00e1 samostatn\u011b vymezen\u00e9 kategorie pozemk\u016f a nezn\u00e1 druh pozemku &#8222;stavebn\u00ed pozemek&#8220;.   <\/p>\n\n<p>I pozemky evidovan\u00e9 v katastru nemovitost\u00ed jako &#8222;orn\u00e1 p\u016fda&#8220; nebo &#8222;zahrady&#8220; mohou b\u00fdt podle \u00fazemn\u00edho pl\u00e1nu stavebn\u00edmi pozemky ur\u010den\u00fdmi k zastav\u011bn\u00ed, ale to z katastru nemovitost\u00ed <strong>nezjist\u00edme<\/strong>, proto\u017ee katastr nevede \u00fadaje o \u00fazemn\u00edm pl\u00e1nu. \u00da\u010delem katastru je p\u0159edev\u0161\u00edm evidence aktu\u00e1ln\u00edch \u00fadaj\u016f, nikoli evidence pl\u00e1novan\u00e9 z\u00e1stavby. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Stavebn\u00ed pozemek &#8211; co to znamen\u00e1 v praxi?<\/strong><\/h2>\n\n<p>Stavebn\u00ed \u00fa\u0159ad (nej\u010dast\u011bji obec) je povinen v \u00fazemn\u00edm \u0159\u00edzen\u00ed a ve stavebn\u00edm \u0159\u00edzen\u00ed zkoumat, zda je z\u00e1m\u011br stavebn\u00edka v souladu s \u00fazemn\u00edm pl\u00e1nem nebo \u00fazemn\u00edm rozhodnut\u00edm, s po\u017eadavky na ochranu \u017eivotn\u00edho prost\u0159ed\u00ed, s po\u017eadavky na ochranu zdrav\u00ed lid\u00ed apod..<\/p>\n\n<p>V p\u0159\u00edpad\u011b stavebn\u00edch pozemk\u016f n\u00e1m bude s nejv\u011bt\u0161\u00ed pravd\u011bpodobnost\u00ed ud\u011bleno \u00fazemn\u00ed rozhodnut\u00ed nebo stavebn\u00ed povolen\u00ed.
