kdy ho pot\u0159ebuji?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Pro prodej i pron\u00e1jem<\/h2>\n\n<p>Podle z\u00e1kona o energetick\u00e9 n\u00e1ro\u010dnosti budov se pojmem &#8222;budova&#8220; rozum\u00ed budova jako celek nebo jej\u00ed <strong>samostatn\u00e1 \u010d\u00e1st<\/strong>, tj. v\u010detn\u011b bytov\u00fdch a nebytov\u00fdch prostor (\u00a7 2 odst. 3).  <\/p>\n\n<p>Podle z\u00e1kona je vlastn\u00edk st\u00e1vaj\u00edc\u00ed budovy (bytu) povinen p\u0159i prodeji nebo pron\u00e1jmu budovy (bytu) p\u0159edat nov\u00e9mu vlastn\u00edkovi\/n\u00e1jemci platn\u00fd energetick\u00fd pr\u016fkaz (nebo jeho kopii) (\u00a7 8 odst. 2 p\u00edsm. c) z\u00e1kona \u010d. 555\/2005 Sb.).<\/p>\n\n<p>Energetick\u00e1 certifikace je povinn\u00e1<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pro budovy nebo jejich jednotliv\u00e9 \u010d\u00e1sti, kter\u00e9 jsou prod\u00e1ny nebo pronajaty nov\u00e9mu n\u00e1jemci,<\/li>\n\n\n\n<li>u budov, kde v\u00edce ne\u017e 250<sup>m2 celkov\u00e9 <\/sup>podlahov\u00e9 plochy zab\u00edr\u00e1 ve\u0159ejn\u00fd org\u00e1n a kde je \u010dasto nav\u0161t\u011bvov\u00e1na ve\u0159ejnost\u00ed,<\/li>\n\n\n\n<li>p\u0159i dokon\u010den\u00ed nov\u00e9 budovy nebo v\u011bt\u0161\u00ed rekonstrukci st\u00e1vaj\u00edc\u00ed budovy; pokuty, banky, po\u017eadavky<\/h2>\n\n<p>N\u011bkter\u00e9 banky \u00fadajn\u011b poskytuj\u00ed slevy na poplatc\u00edch t\u011bm \u017eadatel\u016fm o \u00fav\u011br, kte\u0159\u00ed p\u0159edlo\u017e\u00ed energetick\u00fd pr\u016fkaz bytu.<\/p>\n\n<p>Pokud vlastn\u00edk bytu nespln\u00ed povinnost p\u0159edat p\u0159i <a href=\"https:\/\/www.ondrejhalama.sk\/ako-postupovat-pri-predaji-bytu\/\">prodeji<\/a> certifik\u00e1t k bytu, m\u016f\u017ee mu b\u00fdt podle <a href=\"https:\/\/www.zakonypreludi.sk\/zz\/2005-555\" target=\"_blank\" rel=\"noopener\">z\u00e1kona<\/a> ulo\u017eena pokuta a\u017e do v\u00fd\u0161e 2 000 EUR, v p\u0159\u00edpad\u011b pr\u00e1vnick\u00fdch osob a podnikatel\u016f m\u016f\u017ee b\u00fdt pokuta je\u0161t\u011b vy\u0161\u0161\u00ed.<\/p>\n\n<p>N\u00e1le\u017eitosti energetick\u00e9ho pr\u016fkazu bytu upravuje vyhl\u00e1\u0161ka \u010d. 364\/2012 Sb. <\/p>\n\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"339\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-1024x339.jpg\" alt=\"advok&#xE1;tn&#xED;
