To znamen\u00e1, \u017ee odpov\u00eddaj\u00ed i za p\u0159\u00edpadn\u00e9 <strong>vady<\/strong> projektov\u00e9 dokumentace a za \u0161kody, kter\u00e9 zp\u016fsob\u00ed v souvislosti s v\u00fdkonem sv\u00e9 \u010dinnosti. <\/p>\n\n<p>Mus\u00ed m\u00edt tak\u00e9 <strong>poji\u0161t\u011bn\u00ed<\/strong> odpov\u011bdnosti.<\/p>\n\n<p>Pokud tedy projektant vypracuje projekt stavby, kter\u00fd je v rozporu s <strong>\u00fazemn\u00edm pl\u00e1nem<\/strong>, m\u00e1 objednatel obvykle pr\u00e1vo na opravu projektu, p\u0159\u00edpadn\u011b i na n\u00e1hradu \u0161kody apod.<\/p>\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"604\" height=\"424\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan.png\" alt=\"odpov&#x11B;dnost design&#xE9;ra\" class=\"wp-image-8462\" style=\"width:420px;height:auto\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan.png 604w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan-300x211.png 300w\" sizes=\"(max-width: 604px) 100vw, 604px\" \/><figcaption class=\"wp-element-caption\">\u00fazemn\u00ed pl\u00e1n<\/figcaption><\/figure>\n\n<p><\/p>\n\n<p>Za spr\u00e1vnost a \u00faplnost dokumentace podle \u00a7 45 odst. 2 stavebn\u00edho z\u00e1kona odpov\u00edd\u00e1 projektant. Projektant vypracovan\u00e9ho stavebn\u00edho z\u00e1m\u011bru odpov\u00edd\u00e1 tak\u00e9 za jeho <strong>proveditelnost<\/strong>. Statick\u00fd v\u00fdpo\u010det mus\u00ed b\u00fdt vypracov\u00e1n v takov\u00e9 form\u011b, aby byl kontrolovateln\u00fd. Projektant je povinen p\u0159izvat ke zpracov\u00e1n\u00ed \u010d\u00e1st\u00ed \u00fazemn\u011b pl\u00e1novac\u00ed dokumentace, n\u00e1vrhu <a href=\"https:\/\/www.ondrejhalama.sk\/zmena-uzemneho-planu\/\">\u00fazemn\u011b pl\u00e1novac\u00ed <\/a>dokumentace nebo projektu stavby dal\u0161\u00ed autorizovan\u00e9 projektanty, pokud nen\u00ed opr\u00e1vn\u011bn n\u011bkterou \u010d\u00e1st zpracovat s\u00e1m.    <\/p>\n\n<p>Architekt nebo in\u017een\u00fdr <strong>odm\u00edtne<\/strong> poskytnout slu\u017eby, pokud jsou pokyny klienta v rozporu se z\u00e1konem, jin\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy, p\u0159edpisy komory nebo schv\u00e1lenou <strong>\u00fazemn\u011b pl\u00e1novac\u00ed dokumentac\u00ed<\/strong>, stavebn\u00edm povolen\u00edm nebo slovenskou technickou normou, nebo jsou technicky neprovediteln\u00e9, nebo by jejich proveden\u00ed ohrozilo \u017eivoty nebo zdrav\u00ed ob\u010dan\u016f nebo dobr\u00e9 mravy a klient p\u0159es upozorn\u011bn\u00ed trv\u00e1 na jejich spln\u011bn\u00ed (z\u00e1kon \u010d. 138\/1992 Sb.).<\/p>\n\n<p>Projektant je povinen navrhovat nov\u00e9 budovy a podstatn\u011b rekonstruovan\u00e9 st\u00e1vaj\u00edc\u00ed budovy s vyu\u017eit\u00edm vhodn\u00fdch stavebn\u00edch konstrukc\u00ed, alternativn\u00edch energetick\u00fdch syst\u00e9m\u016f zalo\u017een\u00fdch na <strong>obnoviteln\u00fdch zdroj\u00edch energie<\/strong> a automatizovan\u00fdch \u0159\u00eddic\u00edch, regula\u010dn\u00edch a monitorovac\u00edch syst\u00e9m\u016f v r\u00e1mci technick\u00fdch, funk\u010dn\u00edch a ekonomick\u00fdch podm\u00ednek budovy.<\/p>\n\n<h2 class=\"wp-block-heading\">Zkoum\u00e1n\u00ed design\u00e9ra<\/h2>\n\n<p>Komora je povinna na\u0159\u00eddit p\u0159ezkou\u0161en\u00ed architekta nebo in\u017een\u00fdra na n\u00e1vrh <a href=\"https:\/\/stavebnyurad.gov.sk\/\" target=\"_blank\" rel=\"noopener\">org\u00e1nu <\/a>(\u00da\u0159adu \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed a v\u00fdstavby Slovensk\u00e9 republiky) nebo na z\u00e1klad\u011b vlastn\u00edho zji\u0161t\u011bn\u00ed z d\u016fvodu, \u017ee se dopustil z\u00e1va\u017en\u00fdch odborn\u00fdch nedostatk\u016f p\u0159i poskytov\u00e1n\u00ed slu\u017eeb.<\/p>\n\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"339\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-1024x339.jpg\" alt=\"advok&#xE1;tn&#xED; kancel&#xE1;&#x159; maxlaw\" class=\"wp-image-8038\" style=\"width:556px;height:auto\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-1024x339.jpg 1024w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-300x99.jpg 300w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-600x199.jpg 600w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-768x254.jpg 768w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-1536x509.jpg 1536w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-990x328.jpg 990w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law-441x146.jpg 441w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/08\/max-law.jpg 1715w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Partnerem blogu je MaxLaw, s. r. o. <\/figcaption><\/figure>\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jak\u00e1 m\u00e1te pr\u00e1va, pokud projektant p\u0159i navrhov\u00e1n\u00ed budovy poru\u0161\u00ed \u00fazemn\u00ed vyhl\u00e1\u0161ku?
