{"id":11263,"date":"2024-10-10T15:49:13","date_gmt":"2024-10-10T13:49:13","guid":{"rendered":"https:\/\/www.ondrejhalama.sk\/duplicita-vlastnictvi-definice-a-3-reseni\/"},"modified":"2025-02-10T20:22:25","modified_gmt":"2025-02-10T19:22:25","slug":"duplicita-vlastnictvi-definice-a-3-reseni","status":"publish","type":"post","link":"https:\/\/www.ondrejhalama.sk\/cs\/duplicita-vlastnictvi-definice-a-3-reseni\/","title":{"rendered":"Duplicita vlastnictv\u00ed (definice a 3 \u0159e\u0161en\u00ed)"},"content":{"rendered":"\n<p>Duplicita vlastnictv\u00ed je stav, kdy je v katastru nemovitost\u00ed k pozemku nebo jeho \u010d\u00e1sti zaps\u00e1no vlastnick\u00e9 pr\u00e1vo pro v\u00edce ne\u017e jednoho plnohodnotn\u00e9ho vlastn\u00edka, nebo pokud zapsan\u00e9 spoluvlastnick\u00e9 pod\u00edly k pozemku tvo\u0159\u00ed sou\u010det v\u011bt\u0161\u00ed ne\u017e 1, tj. nad 100 %.  <\/p>\n\n<p>Jedn\u00e1 se o chybn\u00fd stav v katastru nemovitost\u00ed, kter\u00fd vznikl v d\u016fsledku r\u016fzn\u00fdch chyb p\u0159i z\u00e1pisu vlastn\u00edk\u016f nemovitost\u00ed.<\/p>\n\n<h2 class=\"wp-block-heading\">2 z\u00e1kladn\u00ed typy duplikace:<\/h2>\n\n<p><strong>1 typ duplicity: <\/strong>v m\u00edst\u011b, kde je zakreslena parcela E-KN, kter\u00e1 m\u00e1 na listu vlastnictv\u00ed zapsan\u00e9ho vlastn\u00edka, je sou\u010dasn\u011b zakreslena parcela C-KN (nebo jej\u00ed \u010d\u00e1st), kter\u00e1 m\u00e1 na listu vlastnictv\u00ed zapsan\u00e9ho jin\u00e9ho vlastn\u00edka. Tyto duplicity vznikly zejm\u00e9na t\u00edm, \u017ee od 90. let 20. stolet\u00ed st\u00e1t vytvo\u0159il druhou katastr\u00e1ln\u00ed mapu, tzv. mapu ur\u010den\u00e9ho oper\u00e1tu, kter\u00e1 existuje sou\u010dasn\u011b s katastr\u00e1ln\u00ed mapou.     <\/p>\n\n<p><strong>2 typ duplicity: <\/strong>na listu vlastnictv\u00ed jsou zaps\u00e1ny spoluvlastnick\u00e9 pod\u00edly, jejich\u017e sou\u010det je v\u011bt\u0161\u00ed ne\u017e 1\/1, tj. v\u011bt\u0161\u00ed ne\u017e 100 %. P\u0159\u00edklad: Na listu vlastnictv\u00ed jsou zaps\u00e1ny t\u0159i r\u016fzn\u00e9 osoby, z nich\u017e ka\u017ed\u00e1 vlastn\u00ed 1\/2 pod\u00edl na <a href=\"https:\/\/www.ondrejhalama.sk\/definicia-pozemku\/\">pozemku<\/a>, tak\u017ee celkov\u00fd sou\u010det vlastnick\u00fdch pr\u00e1v zapsan\u00fdch na listu vlastnictv\u00ed \u010din\u00ed 150 % (3 x 1\/2). <\/p>\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><a href=\"https:\/\/shop.ondrejhalama.sk\/\" target=\"_blank\" rel=\"noopener\"><img fetchpriority=\"high\" decoding=\"async\" width=\"614\" height=\"876\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/verzia-2-2.png\" alt=\"duplicita vlastnictv&#xED;\" class=\"wp-image-8321\" style=\"width:198px;height:auto\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/verzia-2-2.png 614w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/verzia-2-2-210x300.png 210w\" sizes=\"(max-width: 614px) 100vw, 614px\" \/><\/a><figcaption>-<\/figcaption><\/figure>\n\n<p>Pokud katastr zjist\u00ed duplicitu, m\u011bl by na dot\u010den\u00fdch listech vlastnictv\u00ed zapsat <strong>pozn\u00e1mku o<\/strong> zpochybn\u011bn\u00ed \u00fadaj\u016f katastru ve smyslu \u00a7 29 odst. 3 vyhl\u00e1\u0161ky \u010d. 461\/2009 Sb.  <\/p>\n\n<h2 class=\"wp-block-heading\">Jak se \u0159e\u0161\u00ed duplicita vlastnictv\u00ed?<\/h2>\n\n<p>Odstran\u011bn\u00ed duplicity se provede tak, \u017ee se ur\u010d\u00ed, kdo je pr\u00e1voplatn\u00fdm vlastn\u00edkem dot\u010den\u00e9ho pozemku. T\u00edm se uvede do souladu pr\u00e1vn\u00ed a eviden\u010dn\u00ed stav. To lze prov\u00e9st n\u00e1sleduj\u00edc\u00edmi t\u0159emi zp\u016fsoby:  <\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Na z\u00e1klad\u011b dohody <\/strong>dot\u010den\u00fdch osob, kter\u00e1 se zap\u00ed\u0161e do katastru nemovitost\u00ed formou vkladu.<\/li>\n\n\n\n<li>Podm\u00ednkou tohoto \u0159e\u0161en\u00ed je, \u017ee s n\u00edm dot\u010den\u00e9 osoby souhlas\u00ed <strong>prost\u0159ednictv\u00edm \u0159\u00edzen\u00ed o oprav\u011b chyby v<\/strong> katastr\u00e1ln\u00edm oper\u00e1tu.<\/li>\n\n\n\n<li><strong>Prost\u0159ednictv\u00edm soudn\u00edho \u0159\u00edzen\u00ed o<\/strong> ur\u010den\u00ed vlastn\u00edka pozemku &#8211; rozsudek soudu je n\u00e1sledn\u011b zaps\u00e1n do katastru nemovitost\u00ed.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">Jak se katastr vypo\u0159\u00e1d\u00e1v\u00e1 s duplicitou?<\/h2>\n\n<p>\u00da\u0159edn\u00edci katastru nemovitost\u00ed obvykle <strong>odm\u00edtaj\u00ed povolit <\/strong>vklady (z\u00e1pisy) k duplicitn\u011b zapsan\u00fdm nemovitostem s od\u016fvodn\u011bn\u00edm, \u017ee nemaj\u00ed pr\u00e1vo ur\u010dit vlastn\u00edka. \u010casto je v\u0161ak takov\u00fd postup katastr\u00e1ln\u00edho \u00fa\u0159adu v rozporu se z\u00e1konem.
