Je v\u0161ak d\u016fle\u017eit\u00e9 v\u011bd\u011bt, \u017ee pouh\u00e9 ohl\u00e1\u0161en\u00ed stavebn\u00edmu \u00fa\u0159adu neoprav\u0148uje stavebn\u00edka k zah\u00e1jen\u00ed stavby. Stavbu lze zah\u00e1jit a\u017e pot\u00e9, co stavebn\u00ed \u00fa\u0159ad na z\u00e1klad\u011b ohl\u00e1\u0161en\u00ed vyd\u00e1 p\u00edsemn\u00e9 <strong>ozn\u00e1men\u00ed, \u017ee proti stavb\u011b nem\u00e1 n\u00e1mitky<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\">Kdy je ozn\u00e1men\u00ed dostate\u010dn\u00e9?<\/h2>\n\n<p>Ohl\u00e1\u0161en\u00ed posta\u010d\u00ed pro jednodu\u0161\u0161\u00ed stavebn\u00ed \u010dinnosti, jako jsou n\u011bkter\u00e9 <strong>drobn\u00e9<\/strong> stavby, stavebn\u00ed \u00fapravy nebo n\u011bkter\u00e9 jednoduch\u00e9 stavby. Rozsah stavebn\u00edch \u010dinnost\u00ed, pro kter\u00e9 posta\u010duje ohl\u00e1\u0161en\u00ed, upravuje stavebn\u00ed z\u00e1kon: <\/p>\n\n<p>Posta\u010d\u00ed ozn\u00e1men\u00ed stavebn\u00edmu \u00fa\u0159adu<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pro jednoduchou stavbu, jej\u00ed p\u0159\u00edstavbu a n\u00e1stavbu, pokud tak stanov\u00ed stavebn\u00ed \u00fa\u0159ad v \u00fazemn\u00edm rozhodnut\u00ed,<\/li>\n\n\n\n<li>pro drobn\u00e9 stavby, kter\u00e9 pln\u00ed dopl\u0148kovou funkci ke stavb\u011b hlavn\u00ed a kter\u00e9 nemohou v\u00fdznamn\u011b ovlivnit \u017eivotn\u00ed prost\u0159ed\u00ed;<\/li>\n\n\n\n<li>v p\u0159\u00edpad\u011b stavebn\u00edch \u00faprav, kter\u00e9 podstatn\u011b nem\u011bn\u00ed vzhled stavby, nezasahuj\u00ed do nosn\u00fdch konstrukc\u00ed stavby, nem\u011bn\u00ed zp\u016fsob u\u017e\u00edv\u00e1n\u00ed stavby a neohro\u017euj\u00ed z\u00e1jmy spole\u010dnosti;<\/li>\n\n\n\n<li>pro udr\u017eovac\u00ed pr\u00e1ce, kter\u00e9 by mohly ovlivnit stabilitu budovy, po\u017e\u00e1rn\u00ed bezpe\u010dnost budovy, jej\u00ed vzhled nebo \u017eivotn\u00ed prost\u0159ed\u00ed, a pro v\u0161echny udr\u017eovac\u00ed pr\u00e1ce na budov\u011b, kter\u00e1 je kulturn\u00ed pam\u00e1tkou,<\/li>\n\n\n\n<li>v p\u0159\u00edpad\u011b staveb s\u00edt\u00ed elektronick\u00fdch komunikac\u00ed (nosi\u010d\u016f telekomunika\u010dn\u00edch za\u0159\u00edzen\u00ed) um\u00edst\u011bn\u00fdch na st\u00e1vaj\u00edc\u00edch budov\u00e1ch, kter\u00e9 nep\u0159esahuj\u00ed v\u00fd\u0161ku 6 m, \u0161\u00ed\u0159ku 2,5 m a nezasahuj\u00ed do nosn\u00fdch konstrukc\u00ed budovy,<\/li>\n\n\n\n<li>pro p\u0159\u00edzemn\u00ed budovy elektronick\u00fdch komunika\u010dn\u00edch s\u00edt\u00ed, pokud jejich zastav\u011bn\u00e1 plocha nep\u0159esahuje 25 m2 a v\u00fd\u0161ka 4,5 m,<\/li>\n\n\n\n<li>p\u0159i v\u00fdm\u011bn\u011b nebo dopln\u011bn\u00ed telekomunika\u010dn\u00edch za\u0159\u00edzen\u00ed na st\u00e1vaj\u00edc\u00edch stavb\u00e1ch s\u00edt\u011b elektronick\u00fdch komunikac\u00ed, pokud nedoch\u00e1z\u00ed ke zm\u011bn\u011b stavby,<\/li>\n\n\n\n<li>v p\u0159\u00edpad\u011b reklamn\u00edch staveb, na kter\u00fdch je nejv\u011bt\u0161\u00ed informa\u010dn\u00ed plocha men\u0161\u00ed ne\u017e 3 m2, pokud tento z\u00e1kon nestanov\u00ed jinak,<\/li>\n\n\n\n<li>pro nab\u00edjec\u00ed stanice pro elektromobily do 25 kW, v\u010detn\u011b odb\u011bru elektrick\u00e9 energie pro nab\u00edjec\u00ed stanici jej\u00ed vnit\u0159n\u00ed instalace.<\/li>\n<\/ul>\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><a href=\"https:\/\/shop.ondrejhalama.sk\/produkt\/stavebny-zakon-komentar\/\" target=\"_blank\" rel=\"noopener\"><img fetchpriority=\"high\" decoding=\"async\" width=\"506\" height=\"720\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/10\/hh.png\" alt=\"ohl&#xE1;&#x161;en&#xED; drobn&#xE9; stavby\" class=\"wp-image-8474\" style=\"width:258px;height:auto\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/10\/hh.png 506w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2022\/10\/hh-211x300.png 211w\" sizes=\"(max-width: 506px) 100vw, 506px\" \/><\/a><figcaption>-<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\">Co je k ozn\u00e1men\u00ed p\u0159ilo\u017eeno?<\/h2>\n\n<p>V n\u011bkter\u00fdch p\u0159\u00edpadech je k ohl\u00e1\u0161en\u00ed stavby p\u0159ilo\u017een situa\u010dn\u00ed v\u00fdkres a v p\u0159\u00edpad\u011b jednoduch\u00fdch staveb standardn\u00ed projektov\u00e1 dokumentace a doklady s n\u00e1le\u017eitostmi pro stavebn\u00ed povolen\u00ed. Pokud maj\u00ed b\u00fdt na stavb\u011b, kter\u00e1 je kulturn\u00ed pam\u00e1tkou, prov\u00e1d\u011bny stavebn\u00ed \u00fapravy nebo udr\u017eovac\u00ed pr\u00e1ce, stavebn\u00edk k ohl\u00e1\u0161en\u00ed p\u0159ipoj\u00ed stanovisko org\u00e1nu pam\u00e1tkov\u00e9 p\u00e9\u010de. <\/p>\n\n<p>Dal\u0161\u00ed podrobnosti ozn\u00e1men\u00ed upravuje \u00a7 5 vyhl\u00e1\u0161ky \u010d. 453\/2000 Sb. <\/p>\n\n<h2 class=\"wp-block-heading\">Jak postupuje stavebn\u00ed \u00fa\u0159ad po ozn\u00e1men\u00ed?<\/h2>\n\n<p>Pokud stavebn\u00ed \u00fa\u0159ad nem\u00e1 n\u00e1mitky proti ohl\u00e1\u0161en\u00ed stavby, vyd\u00e1 p\u00edsemn\u00e9 ozn\u00e1men\u00ed a stavebn\u00edk m\u016f\u017ee zah\u00e1jit stavebn\u00ed pr\u00e1ce. Ohl\u00e1\u0161en\u00ed stavebn\u00edho \u00fa\u0159adu nenahrazuje rozhodnut\u00ed, stanoviska, vyj\u00e1d\u0159en\u00ed, souhlasy nebo jin\u00e1 opat\u0159en\u00ed dot\u010den\u00fdch org\u00e1n\u016f vy\u017eadovan\u00e1 zvl\u00e1\u0161tn\u00edmi p\u0159edpisy. <\/p>\n\n<p>Pokud stavebn\u00ed \u00fa\u0159ad na z\u00e1klad\u011b p\u0159edlo\u017een\u00fdch podklad\u016f zjist\u00ed, \u017ee by navrhovanou stavbou mohla b\u00fdt dot\u010dena pr\u00e1va t\u0159et\u00edch osob nebo je nutn\u00e9 stanovit podm\u00ednky pro proveden\u00ed stavby, stanov\u00ed, \u017ee ohl\u00e1\u0161enou stavbu lze prov\u00e9st pouze na z\u00e1klad\u011b stavebn\u00edho povolen\u00ed.<\/p>\n\n<h2 class=\"wp-block-heading\">Kdy mus\u00ed b\u00fdt stavba dokon\u010dena?<\/h2>\n\n<p>Stavebn\u00edk m\u016f\u017ee zah\u00e1jit ohl\u00e1\u0161enou stavbu do dvou let ode dne doru\u010den\u00ed ozn\u00e1men\u00ed stavebn\u00edkovi, pokud stavebn\u00ed \u00fa\u0159ad nestanov\u00ed jinak. Ohl\u00e1\u0161enou reklamn\u00ed stavbu, jej\u00ed\u017e nejv\u011bt\u0161\u00ed informativn\u00ed plocha je men\u0161\u00ed ne\u017e 3 m2, m\u016f\u017ee stavebn\u00edk zah\u00e1jit pouze do 1 roku ode dne doru\u010den\u00ed ozn\u00e1men\u00ed stavebn\u00edho \u00fa\u0159adu stavebn\u00edkovi, pokud stavebn\u00ed \u00fa\u0159ad v od\u016fvodn\u011bn\u00fdch p\u0159\u00edpadech nestanovil pro zah\u00e1jen\u00ed <a href=\"https:\/\/www.ondrejhalama.sk\/definicia-stavby-stavebny-zakon-komentar-43\/\">stavby<\/a> lh\u016ftu del\u0161\u00ed. <\/p>\n\n<h2 class=\"wp-block-heading\">Pozor na neleg\u00e1ln\u00ed stavby<\/h2>\n\n<p>Stavebn\u00edci drobn\u00fdch staveb, u kter\u00fdch posta\u010d\u00ed ohl\u00e1\u0161en\u00ed, by m\u011bli b\u00fdt obzvl\u00e1\u0161t\u011b opatrn\u00ed a v\u0161e \u0159\u00e1dn\u011b ohl\u00e1sit, nebo\u0165 drobn\u00e9 stavby nelze dodate\u010dn\u011b povolit podle \u00a7 88a stavebn\u00edho z\u00e1kona. Z\u00e1konod\u00e1rce se pravd\u011bpodobn\u011b domn\u00edval, \u017ee na dodate\u010dn\u00e9m povolov\u00e1n\u00ed nepovolen\u00fdch drobn\u00fdch staveb nen\u00ed ve\u0159ejn\u00fd z\u00e1jem a m\u011bly by b\u00fdt v\u017edy odstran\u011bny.
