{"id":11103,"date":"2024-12-22T19:20:28","date_gmt":"2024-12-22T18:20:28","guid":{"rendered":"https:\/\/www.ondrejhalama.sk\/building-land-definition-2024\/"},"modified":"2025-02-10T20:19:58","modified_gmt":"2025-02-10T19:19:58","slug":"building-land-definition-2024","status":"publish","type":"post","link":"https:\/\/www.ondrejhalama.sk\/en\/building-land-definition-2024\/","title":{"rendered":"Building land &#8211; definition (2024)"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Building land &#8211; by law<\/strong><\/h2>\n\n<p>The definition under Section 43h of the Building Code reads:<br\/><em>&#8220;Building land means the part of the territory designated by the municipality&#8217;s zoning plan or the zoning plan of a zone or by a zoning decision for development and the land developed with a building.&#8221;<\/em><\/p>\n\n<p>This definition in the Building <a href=\"https:\/\/www.zakonypreludi.sk\/zz\/1976-50\" target=\"_blank\" rel=\"noopener\">Act<\/a> is quite broad, as many plots of land can be used for some kind of building (e.g. residential, or agricultural, etc.).<\/p>\n\n<h2 class=\"wp-block-heading\"><br\/><strong>Building land &#8211; in common parlance<\/strong><\/h2>\n\n<p>In common parlance, we understand &#8220;building land&#8221; to mean mainly land on which houses, apartment buildings, or commercial buildings <strong>can<\/strong> be built. This term is mainly used in advertising. <\/p>\n\n<p>So, if you want to check whether the land is really building land, in most cases you have to look at <strong>the planning plans <\/strong>or zoning decisions (if any). The most up-to-date information can be obtained from the relevant authority (especially the municipality). <\/p>\n\n<p><\/p>\n\n<figure class=\"wp-block-image aligncenter size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"604\" height=\"424\" src=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan.png\" alt=\"building plot definition\" class=\"wp-image-8462\" title=\"-\" srcset=\"https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan.png 604w, https:\/\/www.ondrejhalama.sk\/wp-content\/uploads\/2023\/01\/uplan-300x211.png 300w\" sizes=\"(max-width: 604px) 100vw, 604px\" \/><figcaption>-<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\"><strong>Building land and cadastre<\/strong><\/h2>\n\n<p>It cannot be clearly determined from the Land Registry whether it is a building plot. The Cadastral Act has separately defined categories of land and does not know the type of land &#8220;building land&#8221;.   <\/p>\n\n<p>Even land registered in the cadastre as &#8220;arable land&#8221; or &#8220;gardens&#8221; may be building land designated for development according to the zoning plan, but <strong>we cannot find<\/strong> this <strong>out<\/strong> from the cadastre because the cadastre does not keep data on zoning. The purpose of the cadastre is mainly to record current data and not to record planned development. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Building land &#8211; what does it mean in practice?<\/strong><\/h2>\n\n<p>The building authority (most often the municipality) is obliged to examine in the zoning proceedings and in the construction proceedings whether the builder&#8217;s intention is in accordance with the zoning plan or zoning decision, with the requirements for environmental protection, requirements for the protection of human health, etc..<\/p>\n\n<p>For building plots, we are most likely to be granted planning permission or a building permit.
